These Terms & Conditions govern access to and use of the Neximerce online store available at https://neximerce.com, as well as purchases made through the website.

By accessing the website, placing an order or using our services, you agree to these Terms & Conditions. If you do not agree with these terms, please do not use the website or place an order.

These Terms & Conditions are intended to provide clear information regarding the operation of our online store, the purchase process, payment, delivery, returns, product information and applicable consumer rights.

Nothing in these Terms & Conditions is intended to restrict or exclude any mandatory consumer rights granted to you under applicable European Union or national law.

NexCommerce VCC is the seller and contracting party for purchases made through the Neximerce online store.

Neximerce is an independent online retail store offering keyboards, keyboard sets, accessories, compatible replacement parts and related products.

Neximerce operates as a multi-product retail store and is not itself the original manufacturer or brand owner of the products offered on the website, unless expressly stated otherwise on the relevant product page.

Where applicable, the product page identifies the manufacturer or other relevant product information.

Products may include original products, third-party products, accessories, compatible replacement parts or other products designed to work with equipment manufactured by third parties.


3. Product Compatibility and OEM Disclaimer

Certain products sold through Neximerce may be compatible replacement parts or accessories intended for use with products manufactured by third-party manufacturers.

Unless expressly stated otherwise, Neximerce is not affiliated with, sponsored by, authorized by or endorsed by the original equipment manufacturer (OEM).

We make reasonable efforts to ensure that product descriptions, images, specifications, dimensions, compatibility information and other product details displayed on the website are accurate and up to date.

  • colors may appear differently depending on the customer's screen;

  • packaging may vary from images shown on the website;

  • manufacturers or suppliers may make changes to product specifications or packaging;

  • certain technical specifications may be updated from time to time.

Such differences do not affect your statutory consumer rights where the product does not conform to the contract.

5. Availability of Products

All products displayed on the website are subject to availability.

Displaying a product on the website does not necessarily guarantee that the product will remain available at all times.

If a product becomes unavailable after an order has been placed and we are unable to fulfill the order, we will inform you as soon as reasonably possible and refund any payment already received for the unavailable product.

We reserve the right to correct obvious errors relating to product availability, prices or product information.


6. Prices and Currency

All prices displayed on Neximerce are stated in EUR (€) unless otherwise indicated.

The applicable price is the price displayed on the website at the time the order is placed.

Where required by applicable law, prices include applicable VAT and other mandatory taxes.

Any applicable delivery charges will be clearly communicated before the order is completed.

Neximerce currently offers free standard delivery for orders of €49 or more.

For orders below €49, applicable shipping charges will be displayed during the checkout process or otherwise communicated before the order is placed.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted and confirmed.


7. Promotions and Discounts

From time to time, Neximerce may offer promotional prices, discount codes, seasonal promotions or other special offers.

Unless expressly stated otherwise:

  • promotional offers are subject to availability;

  • discount codes may be subject to specific conditions;

  • only one promotional code may be used per order where the applicable promotion does not state otherwise;

  • promotions may have a specified validity period;

  • promotions cannot be exchanged for cash.

Mandatory consumer rights are not affected by promotional pricing.


8. Placing an Order

To place an order, you select the desired products, add them to your shopping cart and complete the checkout process.

Before submitting an order, you will have an opportunity to review:

  • the products selected;

  • quantities;

  • prices;

  • delivery information;

  • applicable shipping charges;

  • payment method;

  • total order value.

You are responsible for ensuring that the information provided during checkout is accurate and complete.

In particular, please ensure that your name, delivery address, E-mail address and telephone number are correct.


9. Order Confirmation and Contract Formation

After submitting an order, you will normally receive an automated E-mail acknowledging receipt of your order.

An automated order acknowledgement confirms that we have received your order request. It does not necessarily mean that the order has already been accepted if the applicable checkout process or communication states otherwise.

The sales contract is concluded when the order is accepted by Neximerce and the customer receives an order confirmation, unless applicable law provides otherwise.

If we are unable to accept your order, we will inform you and, where payment has already been collected, arrange a refund of the relevant amount.


10. Order Cancellation Before Shipment

If you wish to cancel an order before it has been shipped, please contact us as soon as possible:

We will make reasonable efforts to stop the order before shipment.

However, once an order has entered the fulfillment or shipping process, it may no longer be possible to cancel it before delivery.

In that situation, you may exercise any applicable statutory right of withdrawal in accordance with our Return / Refund Policy .


11. Payment Methods

Neximerce supports payment methods that may include:

  • Visa;

  • Mastercard;

  • American Express;

  • Maestro;

  • UnionPay;

  • Apple Pay;

  • Google Pay.

The payment methods actually available at checkout may vary depending on:

  • the customer's country;

  • payment-provider availability;

  • currency;

  • device;

  • browser;

  • transaction conditions;

  • eligibility requirements of the relevant payment provider.

Therefore, not every payment method will necessarily be available to every customer.

Payment information may be processed directly by the relevant payment service provider.

Neximerce does not intentionally store complete payment-card numbers or card security codes such as CVV/CVC on its own systems.


12. Payment Authorization

Where payment is required at the time of purchase, the order may be processed only after the selected payment method has been successfully authorized.

If payment is declined, reversed, cancelled or otherwise unsuccessful, we may be unable to fulfill the order until valid payment has been received.

Customers should contact the relevant payment provider if they experience problems with payment authorization.


13. Delivery

Neximerce currently offers delivery to selected European markets, including:

  • Bulgaria;

  • Croatia;

  • Slovakia;

  • Germany;

  • Poland;

  • Austria;

  • Hungary.

Our current standard delivery estimates are:

Bulgaria: approximately 1–3 business days.

Other supported destinations: approximately 4–7 business days.

Orders of €49 or more qualify for free standard delivery.

For orders below €49, applicable shipping charges will be displayed before the order is completed.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including courier delays, severe weather, public holidays, customs or other logistical disruptions.

14. Delivery Address

Customers are responsible for providing a complete and accurate delivery address.

If incorrect or incomplete information provided by the customer causes a delivery failure, additional delivery costs or a return to sender, we may contact the customer to arrange an appropriate solution.

Nothing in this section limits any mandatory consumer rights.


15. Inspection Upon Delivery

Customers are encouraged to inspect the package and product as soon as reasonably possible after delivery.

If a package appears seriously damaged upon delivery, customers should, where possible, document the condition of the package and contact Neximerce promptly.

Reporting visible damage as soon as possible helps us investigate delivery-related issues efficiently.

However, failure to report visible damage immediately does not remove statutory consumer rights relating to defective or non-conforming goods.


16. Right of Withdrawal

If you are a consumer within the European Union, you generally have a statutory right to withdraw from a distance contract without giving a reason.

For goods, the withdrawal period is generally 14 days from the day on which you, or a third party designated by you other than the carrier, acquire physical possession of the goods.

To exercise your right of withdrawal, you must communicate your decision to withdraw before the expiry of the applicable withdrawal period.

17. Effects of Withdrawal

Where you validly exercise the statutory right of withdrawal:

  • you must return the goods without undue delay and normally within 14 days after communicating your decision to withdraw;

  • you are generally responsible for the direct cost of returning the goods unless we have agreed to bear those costs or applicable law provides otherwise;

  • we will reimburse the payments received from you in accordance with applicable law;

  • reimbursement may be withheld until we receive the returned goods or you provide evidence that the goods have been returned, whichever occurs first, where permitted by law.

The refund will normally include the cost of standard delivery originally paid by the consumer, but not additional costs resulting from the consumer choosing a more expensive delivery method than the least expensive standard delivery offered.


18. Condition of Returned Products

During the withdrawal period, consumers may handle the goods only to the extent necessary to establish their nature, characteristics and functioning, similar to what would normally be permitted in a physical store.

Where the consumer has handled or used the goods beyond what is necessary to establish their nature, characteristics and functioning, the consumer may be liable for any diminished value resulting from that handling, to the extent permitted by applicable law.

This provision does not remove or restrict any statutory rights relating to defective or non-conforming goods.


19. Exceptions to the Right of Withdrawal

The statutory right of withdrawal is subject to exceptions established by applicable law.

Depending on the circumstances, exceptions may include certain goods:

  • made according to the consumer's specifications or clearly personalized;

  • sealed goods that are not suitable for return for health or hygiene reasons where the seal has been broken;

  • other categories expressly excluded by applicable law.

Any exception will apply only where the legal requirements for that exception are satisfied.

We will not rely on an exception merely because a product has been opened unless the applicable legal requirements are met.


20. Faulty or Non-Conforming Products

The statutory right of withdrawal is separate from your legal rights concerning defective or non-conforming goods.

If a product:

  • is defective;

  • does not correspond to the description;

  • does not have the characteristics advertised;

  • is not fit for its normal purpose;

  • does not meet applicable conformity requirements;

you may have rights to a remedy under applicable consumer-protection law.

EU consumer rules provide a minimum two-year legal guarantee for consumer goods, subject to the applicable rules and national implementation.

Depending on the circumstances, available remedies may include repair, replacement, price reduction or termination of the contract and refund.

Where a defect or non-conformity is caused by misuse, accidental damage, unauthorized modification or use contrary to product instructions, the applicable statutory rules will determine whether the seller remains responsible.


21. Compatibility Claims

For products described as compatible with a particular keyboard, device, model or third-party product, compatibility information is provided to help customers identify intended use.

Customers should carefully review:

  • product title;

  • compatibility list;

  • model information;

  • technical specifications;

  • dimensions;

  • connection type;

  • other compatibility information

before purchasing.

Compatibility with a third-party product does not mean that Neximerce or the product manufacturer has any affiliation with the original manufacturer.

Where a compatibility statement is incorrect or the product does not conform to the contract, applicable statutory consumer rights remain unaffected.


22. Intellectual Property

Unless otherwise stated, the website, including its design, text, graphics, logos, layout, photographs, icons and other original content, is protected by applicable intellectual-property laws.

You may use the website for personal and lawful shopping purposes.

You may not reproduce, distribute, modify, publish, commercially exploit or otherwise use website content without appropriate authorization, except where permitted by applicable law.

Third-party trademarks and brand names remain the property of their respective owners.

Temporary interruptions may occur because of maintenance, technical issues, security incidents, hosting problems or circumstances outside our reasonable control.

Nothing in this section excludes liability that cannot legally be excluded.

  • major technical failures;

  • widespread Internet or telecommunications failures;

  • courier disruptions;

  • other extraordinary events beyond our reasonable control.

Where such circumstances affect an order, we will take reasonable steps to inform the customer and minimize the impact.

This provision does not affect mandatory consumer rights.


29. Limitation of Liability

To the maximum extent permitted by applicable law, Neximerce shall not be liable for indirect or consequential losses that are not reasonably foreseeable or are not legally attributable to our actions.

However, nothing in these Terms & Conditions excludes or limits liability for:

  • death or personal injury caused by negligence where such limitation is prohibited;

  • fraud or fraudulent misrepresentation;

  • intentional misconduct;

  • breach of mandatory consumer rights;

  • defective products where liability cannot legally be excluded;

  • any other liability that cannot legally be excluded or limited.

Consumers retain all mandatory rights provided by applicable EU and national law.


30. Applicable Consumer Protection Laws

These Terms & Conditions do not limit the mandatory consumer protections applicable to customers in the countries in which Neximerce lawfully sells its products.

Depending on the customer's country of residence and the circumstances of the transaction, mandatory provisions of applicable consumer law may apply in addition to these Terms & Conditions.

In particular, consumers retain statutory rights relating to:

  • withdrawal;

  • product conformity;

  • legal guarantees;

  • defective products;

  • refunds;

  • unfair commercial practices;

  • delivery;

  • consumer information.

Contractual terms cannot deprive consumers of mandatory statutory rights.

Nothing in these Terms & Conditions prevents a consumer from exercising any statutory right to submit a dispute to a competent consumer-protection authority, alternative dispute-resolution body or court.

Where applicable, consumers may also contact the competent consumer-protection authority in their country of residence.


33. Governing Law

These Terms & Conditions are governed primarily by the laws applicable to the seller, NexCommerce VCC, established in Bulgaria.

However, where a customer qualifies as a consumer under applicable EU law, this choice of law does not deprive the consumer of the protection provided by mandatory provisions of the law that would otherwise apply to the consumer under applicable EU and national consumer-protection rules.

Nothing in these Terms & Conditions prevents a consumer from relying on mandatory rights granted by the laws of their country of habitual residence where such rights apply.


34. Jurisdiction

For disputes involving consumers, the competent courts will be determined in accordance with applicable mandatory EU and national consumer-protection rules.

Nothing in these Terms & Conditions prevents a consumer from bringing proceedings before a competent court available under applicable law.

For non-consumer commercial matters, the competent jurisdiction shall be determined in accordance with applicable Bulgarian law and procedural rules.


35. Changes to These Terms & Conditions

We may update these Terms & Conditions from time to time to reflect:

  • changes in our business;

  • changes to products or services;

  • changes to payment or delivery arrangements;

  • changes in applicable laws;

  • changes to our website;

  • improvements to customer protection and transparency.

The latest version will be published on the Neximerce website.

Changes will not retroactively alter contractual rights relating to orders that have already been accepted, except where required or permitted by law.


36. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in effect to the extent permitted by applicable law.

The invalid or unenforceable provision shall be interpreted or replaced, where legally possible, in a manner that most closely reflects its original purpose while respecting mandatory legal requirements.


37. Entire Agreement

These Terms & Conditions, together with the applicable product information, order confirmation, Privacy Policy, Shipping Policy and Return & Refund Policy, form the contractual framework applicable to purchases made through Neximerce, subject to mandatory consumer rights.

If there is a conflict between these Terms & Conditions and mandatory consumer-protection law, the mandatory legal provisions will prevail.
